Pegasus Flight Support, Inc. — Effective September 16, 2026
These terms and conditions govern all transactions between Customer and Pegasus Flight Support, Inc. for jet fuel and flight services. Use of this website is also subject to our Privacy Policy.
1. Application
The following terms and conditions shall apply to all transactions between Customer and Pegasus Flight Support, Inc. involving (a) Customer’s purchase of jet fuel (“Jet Fuel”); or (b) flight services (“Flight Services”) provided to Customer by or on behalf of Pegasus Flight Support, Inc. ,including, but not limited to: aviation meteorological forecasting and pilot briefing; trip planning; computerized flight plans; flight plan filing; international flight coordination; arrangements for and coordination of third-party foreign and domestic goods and services; diplomatic clearances; over flight and landing permits; hotel reservations; and access to Pegasus Flight Support’s worldwide network of international service providers for aircraft ground handling; catering; ground transportation; customs, immigration, and quarantine assistance; credit (where approved) with suppliers and service establishments.
2. Prices and Charges for Jet Fuel and Flight Services
Pricing and other charges for Jet Fuel and Flight Services shall be established from time to time by Pegasus Flight Support. If not agreed upon at the time of request, prices for Jet Fuel and Flight Services shall be determined by Pegasus Flight Support, Inc.in its reasonable discretion.
3. Additional Charges
Customer agrees to pay Pegasus Flight Support, Inc., an administrative fee of up to 25% of all non-Jet Fuel items charged on the Pegasus Flight Support, Inc. Contract Fuel Program. Customer further agrees to pay, discharge and/or reimburse Pegasus Flight Support, Inc. for (i) cash and credit advances and fees; and (ii) all additional third-party charges and disbursements incurred for Customer’s benefit.
4. Taxes
Customer shall also pay to Pegasus Flight Support, Inc. all governmental taxes, excises, duties and/or other charges now or hereafter assessed, imposed or levied relative to the Jet Fuel or the Flight Services.
5. Payments
All payments to Pegasus Flight Support, Inc. shall be in United States Dollars unless otherwise agreed by Pegasus Flight Support, Inc. in writing.
6. Invoices
Unless disputed in writing by Customer within 45 days of the invoice date, all invoices shall be deemed correct and accepted by Customer. All disputes shall be forwarded to Pegasus Flight Support, Inc. by hand delivery or fax. Disputes to services by Third-Party Providers will be forwarded by Pegasus Flight Support, Inc. along with letters of inquiry to the Third-Party Providers with a copy to Customer. If Pegasus Flight Support, Inc. has paid the Third-Party Providers prior to receiving Customer’s notice of dispute, Customer shall pay Pegasus Flight Support, Inc. in full, subject to subsequent credit or refund from Pegasus Flight Support, Inc. to the extent of any refund or credit received from the Third-Party Providers. No dispute shall relieve Customer of its obligation to timely pay undisputed portions of the invoice if proven to be requested by the customer.
7. Force Majeure
Pegasus Flight Support, Inc. shall not be required to perform any obligation to Customer if Pegasus Flight Support’s performance is delayed or precluded by one or more conditions beyond Pegasus Flight Support’s reasonable control. Pegasus Flight Support, Inc. shall promptly inform Customer of any such condition. In no event shall such condition excuse Customer’s payment for Jet Fuel or Flight Services that have been provided to Customer.
8. Disclaimer of Warranty / Limitation of Liability
PEGASUS FLIGHT SUPPORT, INC. MAKES NO WARRANTY OR REPRESENTATION, OF ANY KIND OR CHARACTER, EXPRESS OR IMPLIED, WITH RESPECT TO ANY JET FUEL OR FLIGHT SERVICES PROVIDED TO CUSTOMER HEREUNDER. PEGASUS FLIGHT SUPPORT, INC. EXPRESSLY DISCLAIMS AND HEREBY WAIVES ALL WARRANTIES, GUARANTEES, OBLIGATIONS, LIABILITIES, RIGHTS AND REMEDIES WITH RESPECT TO ALL JET FUEL AND FLIGHT SERVICES, EXPRESS OR IMPLIED, ARISING BY LAW OR OTHERWISE, INCLUDING BUT NOT LIMITED TO (a) AN IMPLIED WARRANTY OF MERCHANTABILITY, (b) ANY IMPLIED WARRANTY ARISING FROM THE COURSE OF PERFORMANCE, COURSE OF DEALING OR USAGE OR TRADE OR (c) ANY IMPLIED WARRANTY OF FITNESS. UNLESS CAUSED SOLELY BY PEGASUS FLIGHT SUPPORT’S GROSS NEGLIGENCE OR INTENTIONAL ACT, PEGASUS FLIGHT SUPPORT, INC. SHALL HAVE NO LIABILITY TO CUSTOMER RELATIVE TO ANY CLAIM, LOSS OR DAMAGE, OF ANY KIND OR CHARACTER, ATTRIBUTABLE TO THE JET FUEL OR FLIGHT SERVICES. IN NO EVENT SHALL PEGASUS FLIGHT SUPPORT, INC. BE LIABLE TO CUSTOMER FOR EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO LOSS OF REVENUES OR PROFITS. IT SHALL BE THE RESPONSIBILITY OF CUSTOMER TO MAKE ANY AND ALL INSPECTIONS AND INVESTIGATIONS AS CUSTOMER DEEMS NECESSARY TO ASCERTAIN THE INTEGRITY, FITNESS OR SUITABILITY OF JET FUEL OR FLIGHT SERVICES HEREUNDER
9. Third-Party Providers
Pegasus Flight Support, Inc. has developed and continues to develop a worldwide network of persons and entities to provide Jet Fuel and Flight Services requested by Customer (“Third-Party Providers”). Third-Party Providers are independent contractors, and Pegasus Flight Support, Inc. does not have the right to supervise and does not supervise details of their operations. Pegasus Flight Support, Inc. shall not be liable for the acts and omissions of any such Third-Party Providers. Pegasus Flight Support’s sole obligation shall be to use ordinary care in the selection of any such Third-Party Providers.
10. Indemnity
Excepting only claims attributable solely to Pegasus Flight Support’s gross negligence or intentional act, Customer shall indemnify and hold Pegasus Flight Support, Inc. harmless from any and all claims of any kind or character against Pegasus Flight Support, Inc. attributable, directly or indirectly, to Jet Fuel or Flight Services provided to Customer.
11. SMS Messaging Service
By providing my phone number, I consent to receive SMS text messages from Pegasus Flight Support, Inc. for general two-way communication (conversational messages) about any services provided by Pegasus Flight Support, Inc. Message Frequency: Pegasus Flight Support, Inc. reserves the right to alter the frequency of messages at any time (1-10 messages per month), to increase or decrease the total number of messages. Pegasus Flight Support, Inc. and carriers are not liable for delays or undelivered messages. Message and Carrier Data Rates: Message and data rates may apply based on your mobile carrier’s terms. Privacy Policy: Your information will be handled in accordance with our Privacy Policy. Cancellation/Opt-Out Instructions: You can opt out of receiving SMS messages at any time by replying STOP to any message we send you. After you opt out of text messaging, you will receive one additional message confirming your request has been processed. Help/Customer Support: Text the word HELP to (469) 986-0250 for support or assistance. You may also contact us directly at help@fly2mex.com. Liability: We are not responsible for any charges, errors, or delays in SMS delivery or undelivered messages caused by your carrier or third-party service providers. Participation in SMS messaging is optional, and consent is not a condition of purchase. Supported carriers are not liable for delayed or undelivered messages.
12. Export Control
THE WORD “RESTRICTED COUNTRY” SHALL MEAN THE COUNTRIES LISTED IN COUNTRY GROUPS Q, S, W, Y, AND Z IN SECTION 770 SUPPLEMENT NO. 1 OF THE EXPORT ADMINISTRATION REGULATIONS OF THE UNITED STATES (15 D.F.R. PART 770) CUSTOMER EXPRESSLY AGREES NOT TO RE-EXPORT AND SHALL NOT DIRECTLY OR INDIRECTLY RELEASE OR MAKE AVAILABLE ANY JET FUEL OR FLIGHT SERVICES PROVIDED TO CUSTOMER FROM PEGASUS FLIGHT SUPPORT, INC. TO ANY RESTRICTED COUNTRY OR ENTITY IN A RESTRICTED COUNTRY (OR ANY OTHER COUNTRY AS MAY BE DESIGNATED FROM TIME TO TIME BY THE UNITED STATES DEPARTMENT OF COMMERCE, OR ANY UNITED STATES LAW, RULE, REGULATION OR ORDER, OR ANY TREATY ) OR FOR USE IN SERVICING EQUIPMENT OWNED, CONTROLLED OR USED BY SUCH MILITARY OR POLICE ENTITIES
13. Reformation
If any provision hereunder is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired. Moreover, the parties hereby agree that any invalid provision shall be reformed so as to be valid and enforceable so as to achieve as nearly as possible the purpose and intentions of the parties.
14. Exclusive Benefit
The Jet Fuel and Flight Services provided hereunder are for the sole and exclusive use of Customer. Customer may not transfer any such Jet Fuel or Flight Services to any third-party or allow any third-party to access or use such Jet Fuel or Flight Services.
15. Governing Law
This Agreement is governed by the laws of the state of Texas, and it is agreed that jurisdiction of any legal action connected with this Agreement shall lie exclusively in the state or federal courts located in the state of Texas. Notwithstanding the foregoing, Pegasus Flight Support, Inc. may, at its option, choose to pursue legal action against the Customer in any state in which the Customer does business, where any of the services were furnished, or where jurisdiction may otherwise be proper. In the event of the Customer’s breach or default under the term of this Agreement, the Customer acknowledges and agrees that Pegasus Flight Support, Inc. may invoke any and all statutory or equitable rights (including those of any participating merchants or other third parties which have been assigned to Pegasus Flight Support) in connection with the enforcement of Pegasus Flight Support’s right to payment under this Agreement. The Customer will be liable to Pegasus Flight Support, Inc. for all costs and expenses, including late charges, reasonable attorney’s fees and other costs incurred by Pegasus Flight Support, Inc. in enforcing its rights hereunder. The Customer agrees that in the event of default in payment, Pegasus Flight Support, Inc. may institute suit against the Customer in the aforesaid courts and that service of process by certified mail, return receipt requested, postage prepaid and addressed to the Customer shall be sufficient to confer jurisdiction of said courts, regardless of where the Customer is geographically located or does business.
16. Amendments
Pegasus Flight Support, Inc. may amend these terms and conditions at any time. Customer shall be provided with a copy of such amended terms and conditions, which shall apply to all subsequent transactions with Pegasus Flight Support.
